GENERAL TERMS OF SALE AND USE – MURA

PREAMBLE

Welcome to Mura.

Mura operates this online store to offer artworks and associated products, in a considered, mastered and deliberately singular approach. Each element presented — artwork, material, support or detail — is conceived as a carrier of meaning and memory.

The store is hosted on Shopify, which provides the technical infrastructure. Any commercial relationship is concluded exclusively between the customer and Mura.

By accessing the site or making a purchase, you accept without reservation these General Terms of Sale and Use (GTSU) as well as the Privacy Policy. If you do not accept these terms, you must cease all use of the Services.

SECTION 1 – ACCESS AND USE

You declare that you are of legal age under the legislation applicable in your country of residence, and that you have the legal capacity to enter into a contract.

You are responsible for the accuracy of the information provided during any order or interaction. Any fraudulent, abusive or improper use of the Services will result in immediate suspension of access.

SECTION 2 – ARTWORKS AND PRODUCTS

The paintings offered by Mura are original artworks. Their value is artistic, conceptual and subjective. Each variation of material, texture, light or perception is an integral part of the work and does not constitute a defect within the meaning of the legal guarantee of conformity.

The photographs and visuals presented on the site are representative of the works but cannot accurately reproduce the nuances perceptible in the physical presence of the work — which is inherent to the nature of original art.

Clothing (t-shirts) is offered as objects extending the artistic universe, intended for strictly personal use.

No reproduction, distribution, modification or commercial exploitation of the works or visuals is authorized without Mura's prior written consent.

SECTION 3 – ORDERS AND ACCEPTANCE

Any order constitutes a firm purchase offer on your part. Mura reserves the right to accept or refuse it, notably in the event of unavailable stock, obvious pricing error or abnormal order.

An order is only considered accepted after written confirmation and effective collection of payment.

In accordance with Directive 2011/83/EU, you will receive an order confirmation by email summarizing the essential elements of your purchase (product, price, deadlines, rights).

The return and refund conditions are governed by the applicable Return Policy, available on the site.

SECTION 4 – PRICES, DEPOSITS AND PAYMENTS

Prices are indicated in euros, all taxes included, excluding shipping costs. Applicable shipping costs are indicated before order validation.

For certain artworks, installment payment (deposit then balance) may be considered. No installment payment is automatic. The customer must contact Mura by email at contact@murareference.com before any payment in order to define the contractual terms together.

In the event of non-compliance with the contractual commitments accepted at the time of purchase, penalties may apply in accordance with the conditions defined in the contract signed between the parties.

SECTION 5 – RIGHT OF WITHDRAWAL

In accordance with European Directive 2011/83/EU, you have a period of 14 days from receipt of your order to exercise your right of withdrawal, without having to justify your decision.

The terms for exercising this right and the return conditions are detailed in the Return and Refund Policy available on the site.

Exception to the right of withdrawal (Art. 16 of Directive 2011/83/EU):

  • Artworks made to measure or personalized according to your specifications are expressly excluded from the right of withdrawal

Items purchased on sale benefit from the same right of withdrawal as other items.

SECTION 6 – SHIPPING AND TRANSFER OF RISK

The delivery times indicated are given for guidance only. Mura undertakes to ship orders within a reasonable time after confirmation.

In accordance with Article 20 of Directive 2011/83/EU, the risk of loss or damage is transferred to the customer upon physical delivery of the goods, and not upon handover to the carrier — unless the customer has chosen a carrier not offered by Mura.

Any handling, hanging or display of an artwork after receipt engages the customer's exclusive responsibility for its conservation.

In the event of significant delay or modification of your order, you will be informed by email as soon as possible.

SECTION 7 – RESALE AND RIGHTS ON ARTWORKS

No resale of products (clothing) is authorized for commercial purposes.

Exception — original artworks: The resale of an artwork acquired from Mura may be considered only upon prior written request sent to contact@murareference.com. Failing prior written agreement, Mura reserves the right to assert its rights, notably under the artist's resale right (droit de suite) recognized by French and European law.

SECTION 8 – INTELLECTUAL PROPERTY

All site content (artworks, texts, visuals, videos, graphic identity) is the exclusive property of Mura and is protected by copyright and applicable intellectual property rights.

Any unauthorized reproduction, representation, modification or exploitation constitutes infringement punishable by civil and criminal penalties.

SECTION 9 – REVIEWS AND COLLABORATIONS

Reviews or feedback spontaneously sent to Mura may be used for communication purposes, unless expressly objected to.

Any collaboration, public testimonial or joint communication must be the subject of prior written agreement: contact@murareference.com

SECTION 10 – PERSONAL DATA

Personal data collected within the Services is processed in accordance with the Privacy Policy available on the site, and with the provisions of Regulation (EU) 2016/679 (GDPR).

SECTION 11 – LEGAL GUARANTEES

In accordance with Articles L.217-4 et seq. of the French Consumer Code, and with Directive 2019/771/EU on the conformity of goods, you benefit from the legal guarantee of conformity and the guarantee against hidden defects.

For original artworks, the notion of conformity is assessed taking into account their unique nature and the variations inherent to artistic creation, expressly accepted at the time of purchase.

SECTION 12 – APPLICABLE LAW AND DISPUTE RESOLUTION

These GTSU are governed by French law.

In the event of a dispute, an amicable solution will be sought as a priority. Failing this, you may use a consumer mediator. As a European consumer, you may also use the European Commission's online dispute resolution platform: https://ec.europa.eu/consumers/odr

These policies were written with rigor, care and a genuine desire to frame the relationship between Mura and its clients — or its visitors, for one enters here as into a gallery.

There is in these texts no will to harm, to trap or to unbalance.
Mura seeks neither excessive profit nor the impoverishment of the other.
Mura seeks art. And what art allows: a fair, conscious, respectful encounter.

Mura sincerely wishes to establish a relationship of trust with those who enter its universe.
